If writing a new notice and choosing "private" but not a recipient group but leave the pull-down menu set on "To: Everybody" the notice is send to everybody overwriting the click on the "private" button.
I think it would be nice to have a request pop-dialog or something asking/warning the user that these two do not mix well together.
See http://saf.li/97_Sw for my initial test of private notices.

If I understand this correctly, "Private" limits the visibility to the chosen group. When the group is "everyone", a "private" post will only be visible to everyone. Which seems to be both confusing and useless.
Perhaps (instead of showing a warning as suggested by bavatar) the option to click "private" should be removed when the "everyone" group is selected. This should be easy to fix with javascript.
A warning could be displayed for those who do not have javascript activated. This is also easy to solve by having javascript remove the message: If javascript isn't activated, you see the warning. If javascript is activated, it removes the warning and hides the "private" option when "everyone" is selected.
